Interpretation of the latest "cosmetics label management approach"

The Measures for the Administration of Cosmetic Labels will be formally implemented from May 1, 2022. On May 31, 2021, the State Food and Drug Administration issued Announcement No. 77 of 2021, "Measures for the Administration of Cosmetic Labels" (hereinafter referred to as the "Measures"), which requires:
From May 1, 2022, cosmetics that apply for registration or filing must comply with the provisions and requirements of the Measures;
If cosmetics that have previously applied for registration or filing have not been labeled in accordance with the provisions of these Measures, the cosmetic registrant and the filing person must complete the update of the product label before May 1, 2023 to make it comply with the provisions of the Measures And requirements.
The following is a summary of the issues that need to be focused on in the Methodology:
Scope of the label
Cosmetic labels refer to the words, symbols, numbers, patterns and other marks used to identify the basic information, attribute characteristics and safety warnings of the product, as well as the packaging containers, packaging boxes and instructions with identification information.
The minimum sales unit of cosmetics should have a label.
The label shall comply with the requirements of relevant laws, administrative regulations, departmental rules, mandatory national standards and technical specifications, and the content of the label shall be legal, true, complete and accurate, and consistent with the relevant content of the product registration or filing. Cosmetic labels should be clear, long-lasting, easy to identify, read, there must be no printing off, paste is not firm and so on.
Ten basic contents of Chinese label
Cosmetics should have a Chinese label. The Chinese name of the product shall be marked at a prominent position on the visible surface of the sales package, and at least one of the leading words shall be used.
Chinese labels should also use standard Chinese characters. If other words or symbols are used, the corresponding explanation and explanation of standard Chinese characters shall be used on the visible surface of the product sales package, except for the website address, the name and address of overseas enterprises and the established professional terms that must be used in other words. If a Chinese label is affixed, the content of the product safety and efficacy claim of the Chinese label shall be consistent with the relevant content of the original label. In addition to the registered trademark, the font size of other characters on the same visible surface of the Chinese label shall be less than or equal to the font size of the corresponding standard Chinese character font. For products with packaging boxes, the Chinese name and service life of the product shall also be marked on the packaging container that is in direct contact with the contents.
The Chinese label of cosmetics shall at least include:
* Product Chinese name, special cosmetics registration certificate number;
* The name and address of the registrant and the filing person, and if the registrant or the filing person is an overseas enterprise, the name and address of the domestic responsible person shall be marked at the same time;
* The name and address of the manufacturer, and the production license number of the manufacturer shall be marked at the same time for domestic cosmetics;
* Standard number of product implementation;
* All components. The cosmetic label shall be marked with the standard Chinese name of the raw materials of all components of the cosmetic on the visible surface of the sales package, with "component" as the leading word, and shall be listed in descending order of the content of each component in the product formula. Where there is an ingredient in a cosmetic formulation that does not exceed 0.1%(w/w), all ingredients that do not exceed 0.1%(w/w) shall be separately labeled with "other minor ingredients" as a guide and may not be listed in descending order of ingredient content.
* Net content, expressed in national legal units of measurement;
* The service life can be marked in three ways: "production date and shelf life", "production batch number and deadline" and "production batch number and service life after opening.
* Method of use;
* Necessary safety warning terms, laws, administrative regulations, departmental rules, mandatory national standards, and technical specifications have warning terms and safety matters for restricted and permitted components of cosmetics, or cosmetics for special groups such as children. Relevant labeling requirements shall be implemented as required;
* Other contents that should be marked according to laws, administrative regulations and mandatory national standards.
Prohibit labeling content
* Use medical terms, names of medical celebrities, words describing medical effects and effects, or approved drug names to express or imply that the product has medical effects;
* use false, exaggerated, absolute words to make false or misleading descriptions;
* Using trademarks, patterns, font color size, color difference, homophonic or suggestive characters, letters, Chinese pinyin, numbers, symbols, etc. to imply medical effects or make false claims;
* Mislead consumers by using terms and mechanisms that have not been widely accepted by the scientific community;
* Mislead consumers by fabricating false information, belittling other legitimate products, etc;
* Use fictitious, forged or unverifiable scientific research results, statistics, survey results, abstracts, quotations and other information to mislead consumers;
* By claiming the function of the raw materials used, it implies that the product does not actually have or does not allow the claimed efficacy;
* The use of labels, rewards, etc. that have not been confirmed by the relevant industry authorities for cosmetics safety and efficacy related claims and terms;
* Use the names and images of state agencies, institutions, medical institutions, public welfare institutions and other units and their staff, and appointed experts as certificates or recommend;
* an assertion or guarantee of efficacy or safety;
* Labeling vulgar, feudal superstition or other content that violates social public order and good customs;
* Other contents prohibited by laws, administrative regulations and mandatory national standards for cosmetics.
