South Korea K-REACH Registration
The South Korea Chemical Registration and Evaluation Act (The Act on Registration and Evaluation of Chemicals) was formally implemented on January 1, 2015. According to the requirements of the Act, from January 1, 2019, existing chemical substances exported to South Korea exceeding 1 ton/year must complete pre-registration and post-pre-registration before they can continue to be exported to the South Korea market. Pre-registration has passed the deadline of June 31, 2019. Existing chemical substances currently South Korea for export for the first time can also be pre-registered after submission. Substance submitted for post-pre-registration shall be formally registered within the buffer period. Chinese producers and exporters cannot register their K-REACH on their own and must appoint a South Korea "sole representative" (OR) to register them.
Scope of K-REACH exemption
Radioactive substances, pharmaceuticals and medical supplies, drugs, cosmetics and raw materials used in cosmetics, pesticides and raw materials, fertilizers, food, food additives, containers, packaging,
Feed, gunpowder, munitions (except for commercial supplies under the Munitions Management Act), health foods, medical devices, personal care products, biocides and biocides
Note: With the exception of the above-mentioned exemptions, all others fall under the jurisdiction of the K-REACH.
K-REACH Registration Type
K-REACH registration targets are mainly new chemical substances, existing chemical substances and consumer products containing priority substances.
For new chemical substances, the following registration types are K-REACH:
- Declaration: less than 0.1 tons;
- A small number of registration: less than 0.1-1 tons;
- General registration: 1 ton and above;
Application for registration exemption: including the following 8 cases:
1. Chemical substances for export only (annual unit)
2. When used in the manufacture of other chemicals for export only (annual unit)
3, reagent and other scientific experiment analysis or research (the first 1)
4, research and development of chemical substances (research and development project units)
5, low concern polymer (first 1)
6. Surface treatment reactants that are not or have completed the declaration/registration of the object substance
7. Non-isolated intermediates (first time)
8. On-site isolation intermediates to prevent leakage by technical methods (first time)
For existing chemical substances, the following registration types are K-REACH:
General separate registration: the first batch of 510 registered target substances above 1 ton year A (joint registration for these substances was closed on September 30, 2018);
Pre-registration: existing chemical substances except the first batch of 510 registered substances (as of June 30, 2019);
Formal registration: each registrant shall complete the joint registration (or separate registration) within the corresponding buffer period according to the registered tonnage.
For consumer products containing priority substances, the following registration types are K-REACH:
Declaration: The weight ratio of key management substances in the product exceeds 0.1 & the annual total amount exceeds 1 ton.
K-REACH penalty clause
K-REACH regulations provide specific penalties for non-compliance with the regulations. For those who fail to declare/register/change registration, they shall be sentenced to imprisonment of not more than 5 years or a fine of not more than 0.1 billion won, termination of sales or recovery of sales products. In addition, the revised K-REACH Act in 2018 also increased the fine system, the amount of which is less than 5% of illegal sales.
Chinese enterprises K-REACH response measures
Chinese enterprises need to pay attention to the following points in order to smoothly deal with South Korea K-REACH registration:
1, product composition list management and regulatory confirmation;
2. Confirmation of existing export records and discussion of future export plans;
3. Mutual cooperation with South Korea importers;
4, the registration of the target substance period confirmation and establish a registration plan;
5, the selection of consulting firms (OR agents) and the establishment of registered technical solutions;
