On July 10, 2013, the Measures for the Administration of Physical Hazard Identification and Classification of Chemicals (hereinafter referred to as the Measures) were formally signed and will be formally implemented on September 1, 2013.
The Measures for the Administration of Physical Hazard Identification and Classification of Chemicals are formulated in accordance with the Regulations on the Safety Management of Hazardous Chemicals to guide chemical production and import enterprises to conduct physical hazard identification and classification of chemicals whose hazardous characteristics have not yet been determined, to obtain physical hazard characteristics, and to determine whether hazardous chemical registration and other related work are required.
Which products need to be identified?
(I) chemicals that contain more than one component listed in the List of Hazardous Chemicals, but whose overall physical hazard has not been determined;
(II) chemicals not listed in the Catalogue of Hazardous Chemicals and whose physical hazard has not been determined;
(III) for the purpose of scientific research or product development, the annual production or use of more than 1 ton of chemicals, and the physical risk has not been determined.
In addition, the supplementary provisions of the "Measures" also stipulate that for chemicals that have been listed in the "List of Hazardous Chemicals", if they are found to have new physical hazards, physical hazard identification and classification should also be carried out.
Relevant government departments
State Administration of Work Safety:
(1) Responsible for guiding, supervising and managing the national physical hazard identification and classification of chemicals;
(2) Announce the list of chemical physical hazard appraisal institutions;
(3) Announces the list of chemicals exempted from identification and classification;
(4) Establish a technical committee on physical hazard identification and classification of chemicals.
Technical Committee on Identification and Classification of Physical Hazards of Chemicals:
(1) Arbitration of the appraisal or classification results with objections;
(2) Publish the identification results of the physical hazards of chemicals.
The Chemical Registration Center of the State Administration of Work Safety (hereinafter referred to as the Registration Center):
(1) Assessment and review of the physical hazard classification results of chemicals;
(2) Establish a national chemical physical hazard identification and classification information management system.
Obligations required by the enterprise
●The enterprise shall conduct a general survey and physical hazard identification of the chemicals produced or imported by the unit, and apply to the appraisal agency for appraisal of the chemicals that meet the appraisal requirements;
● The enterprise shall submit a report on the physical hazard classification of chemicals to the registration center;
The enterprise shall establish the physical hazard identification and classification management files of chemicals;
For chemicals classified as hazardous chemicals and hazardous chemicals exempted from identification and classification, enterprises shall prepare chemical safety technical specifications and safety labels, and register hazardous chemicals within six months in accordance with the relevant provisions of the State on the registration of hazardous chemicals.

Penalties for violations
The enterprise has one of the following situations:
● Failure to identify or classify the physical hazards of chemicals in accordance with the provisions of these Measures;
● Failing to establish the physical hazard identification and classification management files of chemicals in accordance with the provisions of these Measures;
In the process of handling the identification of the physical hazard of chemicals, concealing the dangerous composition, content and other relevant information of chemicals or providing false materials.
Will be ordered to make corrections within a time limit and may be fined less than 10000 yuan; those who refuse to make corrections shall be fined between 10000 yuan and 30000 yuan.
