What is the difference between dangerous chemicals and dangerous goods?

Concept and proposed department

The Regulations on the Safety Management of Hazardous Chemicals (Order No. 591 of the State Council of the People's Republic of China) stipulates that hazardous chemicals refer to highly toxic chemicals that are toxic, corrosive, explosive, burning, and combustion-supporting, and are harmful to humans, facilities, and the environment. And other chemicals. Hazardous chemicals shall be judged by the Catalogue of Hazardous Chemicals (hereinafter referred to as the Catalogue), which shall be determined, published and adjusted in due course by the work safety supervision and administration department of the State Council in conjunction with the departments of industry and information technology, public security, environmental protection, health and transportation under the State Council in accordance with the criteria for the identification and classification of hazardous characteristics of chemicals.

 

According to the Classification and Name Number of Dangerous Goods (GB 6944), dangerous goods refer to substances and articles that have explosive, flammable, toxic, infectious, corrosive, radioactive and other dangerous characteristics and are likely to cause personal injury or death, property damage or environmental pollution and need special protection during transportation, storage, production, operation, use and disposal. The principle of confirmation of dangerous goods in China is mainly based on the "List of Dangerous Goods" (GB 12268) and "Classification and Number of Dangerous Goods" (GB 6944). These two national standards are proposed by the Ministry of Transport and organized to revise and issue.

The main difference between dangerous chemicals and dangerous goods

Dangerous chemicals contain only chemical substances, and dangerous goods contain substances and articles, both of which have special requirements for packaging.

 

Dangerous goods do not belong to dangerous chemicals, mainly divided into the following three kinds: the goods belong to dangerous goods, do not belong to chemical substances, such as automobile airbags; the goods transport conditions are special, such as high temperature transportation; the danger of the goods is not among the 28 hazards of dangerous chemicals, such as lithium batteries.

 

The main reason why hazardous chemicals are not classified as dangerous goods is that many sub-chronic health and environmental hazards (carcinogenicity, reproductive toxicity, etc.) are not adopted by the classification standards for dangerous goods, such as boric acid.

Classification

The Catalogue divides the hazardous characteristics of hazardous chemicals into 28 items in three categories: physical hazards, health hazards and environmental hazards (the sixth revised edition of GHS has expanded hazardous chemicals to 29 categories and added desensitized explosives, but at present, the confirmation principle of hazardous chemicals in China only includes 28 categories), which means that chemicals are hazardous chemicals when they contain one or more of these 28 hazards.

 

Dangerous goods can be divided into 9 categories, including:

Explosives, gases, flammable liquids, flammable solids, substances prone to spontaneous combustion, substances that emit flammable gases when exposed to water, oxidizing substances and organic peroxides, toxic and infectious substances, radioactive substances, corrosive substances, miscellaneous hazardous substances and articles including environmentally hazardous substances.

 

Goods are dangerous when they contain one or more of these hazards.

Customs supervision requirements

According to the "the People's Republic of China Import and Export Commodity Inspection Law" and its implementing regulations, "Regulations on the Safety Management of Hazardous Chemicals" "Announcement on Issues Relating to the Inspection and Supervision of Import and Export Hazardous Chemicals and Their Packaging" (General Administration of Customs Announcement No. 129 of 2020) and other relevant provisions, the products in the "Catalogue" are statutory inspection commodities. The customs adopts the port supervision mode of "batch inspection and sampling inspection" for imported hazardous chemicals. The consignee or his agent of imported hazardous chemicals shall fill in relevant matters and apply for inspection when making customs declaration; the customs shall adopt the supervision requirements of "origin inspection + port inspection" for exported hazardous chemicals. The consignor or his agent of exported hazardous chemicals shall apply to the customs of the place of origin for inspection and application for inspection.

 

In addition, it is necessary to remind that the safety management of the production, storage, use, operation and transportation of hazardous chemicals must comply with the regulations on the safety management of hazardous chemicals. Whether or not dangerous chemicals are listed in the legal inspection catalogue, they must apply to the customs for inspection and inspection according to law. If the export of dangerous chemicals belongs to dangerous goods, they should also apply to the customs of the place of origin for the identification of the packaging and use of the export of dangerous goods. The import and export of hazardous chemicals used as food and food additives shall comply with relevant food safety regulations.
