On June 21, 2019, the "Notice on Supplementing and Perfecting the List of Existing Chemical Substances in China" (hereinafter referred to as the "Notice") was issued, changing the situation that chemical substances that have been legally produced or imported in China before the implementation of the registration system in recent years have met the conditions for inclusion in the list, but there has been no official application channel. On January 1, 2021, the "Measures for the Registration of Environmental Management of New Chemical Substances" (hereinafter referred to as the "Measures") was formally implemented. The "Measures" and the registration guidelines made it clear that chemical substances legally produced or imported in China before October 15, 2003 were part of the list, and at the same time stipulated that enterprises producing, importing and using relevant chemical substances, relevant industry associations and other relevant units could submit supplementary applications at any time, the window for additions to the directory will remain open after the new regulation takes effect.

Since the issuance of the notice, 6 batches of 640 substances have been added to the list, of which 4 batches of 246 substances have been listed in the announcement after the implementation of the measures. For new substances intended to be produced, imported or processed in China, if relevant certification materials that have been produced, imported, sold or processed and used in China before the implementation of the environmental management registration system for new chemical substances can be provided, an application for supplement can be submitted in accordance with the procedures, and the supplement and inclusion in the list after approval can be added. Compared with regular registration and inclusion in the list, this method can save a lot of time and money.

General requirements

Chemical substances that have been produced, sold, processed or imported in the People's Republic of China before the implementation of the new environmental management registration system for chemical substances, that is, before October 15, 2003, can be added to the "List".

Applicant

For chemical substances that have been produced, sold, processed, used or imported in the People's Republic of China before October 15, 2003, enterprises producing, importing, processing and using relevant chemical substances, relevant industry associations and other relevant units may apply for supplementary inclusion in the list.

Submission of information

The applicant shall submit the supplementary application form and relevant supporting materials, including:

1) Distribution invoices for chemical substances;

2) Import and export declaration form;

3) industry statistical materials, chemical yearbook;

4) Documents issued by the management department;

5) public publications;

6) Other materials that can prove that the chemical substance has been produced, sold, processed or imported in the People's Republic of China before October 15, 2003.

Audit Results

The competent department of ecological environment under the State Council shall make a decision according to the examination and publicity opinions.

1, after examination that the application materials do not meet the requirements, will not be added.

2. The chemical substances that meet the supplementary requirements after examination shall be publicized on the government website of the competent department of ecological environment under the State Council, and the announcement shall be added to the list without objection.

The substances listed in the list by means of supplement are not allowed to be protected by chemical substance identification information, and the material information is made public. The public content includes: Chinese name, English name, Chinese alias, English alias, molecular formula, CAS number or serial number (CAS number is unknown).

The chemical substances entered into the list in this way do not involve the content of environmental management requirements for new uses and have no use restrictions.

Submitted through the online registration system of the government service hall of the Ministry of Ecology and Environment.

Filling method

When applying, log in to the government service hall of the Ministry of ecological environment, click on the item declaration of "approval items for the issuance of 13002 new chemical substance environmental management registration certificate", select more items under the registration business item, click on the "application for supplement and inclusion in the list", fill in the corresponding contents, sign the seal after completion and upload the data for submission.

Before filling in the online platform, the enterprise account registration must be completed, and the registered account must be filled in after logging in. The relevant information in the review process will be informed by the official through the system message. If relevant information is submitted, the system message should be paid attention to at any time.

In addition, the supplement of the list is not an administrative examination and approval item, and there is no clear time limit for examination and approval.
