South Korea new chemical substance information that has passed the confidentiality period can still apply for extension.

Recently, the National Academy of Environmental Sciences (NIER) of South Korea released the draft results of the hazard assessment of chemical substances No. 2022-417, and solicited opinions on whether to disclose the information of substances that have applied for commercial information confidentiality (CBI).
According to the South Korea Chemical Registration Evaluation Law, after the registration or notification of new substances is completed, enterprises can apply for commercial information confidentiality (CBI), such as the confidentiality of substance name, CAS number and other information. The confidentiality of the initial commercial information is valid for 5 years, but it can be extended twice at a later stage, each extension is up to 5 years, that is, after the expiration of the confidentiality of the initial commercial information, it can be extended for up to 10 years.
The published draft contains 347 new chemical substances, including those with data protection expiration dates in 2020 and 2021, which used common names when they were protected by the CBI. With the expiration of the confidentiality of commercial information, the authorities will disclose the chemical names and CAS numbers of these substances after the draft is adopted.
However, if the enterprise that applied for the confidentiality of commercial information at the beginning still has requirements for the confidentiality of material information, it can apply to the South Korea National Academy of Environmental Sciences for another extension in time. If the application is successful, the name of these substances, CAS number and other information will continue to be kept confidential to the public.
