According to the announcement of the State Food and Drug Administration on matters related to the implementation of the regulations on the Supervision and Administration of Cosmetics (No. 144 of 2020), starting from January 1, 2021, special-purpose cosmetics such as hair care, hair removal, breast care, bodybuilding and deodorization as stipulated in the regulations on Hygiene Supervision of Cosmetics are no longer managed in accordance with special cosmetics, and the State Drug Administration will no longer accept applications for registration of relevant products and issue administrative licenses for special-purpose cosmetics. The State Drug Administration shall terminate the examination and approval of products belonging to ordinary cosmetics or products that do not belong to cosmetics according to the regulations; for products belonging to special cosmetics according to the regulations, the applicant may continue to review and approve according to the procedures after adjusting the application materials.

On February 3, 2021, the China Institute for Food and Drug Control issued an announcement on the transitional treatment rules for five types of special-purpose cosmetics such as Yufa.

In accordance with the provisions of the State Drug Administration's Announcement on the Implementation of the Regulations on the Supervision and Administration of Cosmetics (No. 144 of 2020) on the transitional management of five types of special-purpose cosmetics such as hair growth, China Food and Drug Control Institute (Hereinafter referred to as the "China Inspection Institute") handles the five types of special-purpose cosmetics for hair growth, hair removal, beauty milk, bodybuilding and deodorization as follows according to different situations:

1. hair removal, beauty milk, bodybuilding and deodorant four types of products

The cosmetics administrative licensing management system has accepted a total of 170 products of four categories: depilation, beauty milk, bodybuilding and deodorization that have not yet made an administrative licensing decision (see Table 1 for specific information). The applicant shall go through the return formalities of the original application materials in the following two ways before March 31, 2021:

The (I) shall present the acceptance notice (the original with the special seal of the State Drug Administration for administrative license acceptance), the power of attorney (with the official seal of the applicant) and the copy of the ID card of the handling person to the Administrative Acceptance Service Hall of the State Drug Administration (hereinafter referred to as the acceptance hall) to receive the original application materials on site;

After the (II) mail the acceptance notice (the original stamped with the special seal of the State Drug Administration for administrative license acceptance) and the return statement (stamped with the official seal of the applicant) to the acceptance hall, the Chinese People's Procuratorate will return the original application materials according to the address and contact person in the return statement.

The original application materials not received within the prescribed time limit will be filed by the Central People's Procuratorate and handed over to the State Drug Administration.

2. Hair Products

A total of 133 hair-raising products have been accepted in the cosmetics administrative licensing management system (see Table 2 for specific information). The Central Inspection Institute will issue a review opinion of "Please confirm the product category. If it belongs to anti-alopecia cosmetics, please adjust and supplement relevant information according to the current laws and regulations". The applicant will handle it in the following two ways:

If the (I) is confirmed to be anti-hair loss cosmetics in accordance with the "Regulations on the Supervision and Administration of Cosmetics", the applicant shall adjust and supplement relevant information in accordance with the current regulations, and the administrative license application will continue to be reviewed and approved in accordance with the procedures.

If the (II) confirms that it belongs to cosmetics but does not belong to anti-hair loss cosmetics in accordance with the "Regulations on the Supervision and Administration of Cosmetics", the applicant may subsequently apply for the record of ordinary cosmetics. When filing, the product inspection report, safety assessment data and relevant supporting documents in the original administrative license application materials can be submitted as filing materials. As the original relevant materials have been submitted with the original administrative license application and cannot be obtained, a copy can be provided and stamped with the official seal of the applicant, and relevant information explanations can be submitted at the same time.

If the review opinions of "please confirm the product category, if it belongs to anti-alopecia cosmetics, please adjust and supplement relevant information according to the current regulations" issued by the central inspection institute fail to submit supplementary information within the prescribed time limit, the processing shall not be approved according to the failure to submit supplementary information within the prescribed time limit, and the central inspection institute shall uniformly file the information and hand it over to the state drug administration.

3. hair and other five types of product approval reissue, error correction and change.

If the applicant applies for reissuing, correcting and changing the approval documents of five kinds of special-purpose cosmetics for hair raising, hair removal, beauty milk, bodybuilding and deodorization (only for changing the name of the production enterprise or the actual production enterprise, the address of the production enterprise, the address description of the actual production enterprise (the address of the actual production enterprise has not changed) or the responsible person in China), the administrative license application will continue to be accepted and reviewed and approved in accordance with the procedures, and approved, and other licensing matters will not be accepted.
