K-REACH joint registration, the South Korea government urges you to move!

On July 1, 2020, the South Korea government issued a letter urging enterprises that need to complete the joint registration of K-REACH in 2021, but have not yet acted, to act quickly, the main contents of the notice are as follows:

 

According to Article 10 of the Chemical Substances Registration and Evaluation Act (hereinafter referred to as the Chemical Assessment Act), enterprises that manufacture and import/export more than 1 ton of existing chemical substances each year must first make K-REACH pre-registration and obtain the corresponding grace period. Grace periods are specified as follows: 1000 tons and above & CMR1 tons of substances (December 31, 2021),100-1000 tons (December 31, 2024),10-100 tons (December 31, 2027),1-10 tons (December 31, 2030). If the registration procedures are not fulfilled within the grace period and the production and import continue after the grace period, the penalty shall be fixed-term imprisonment of not more than 5 years or a fine of not more than 0.1 billion won in accordance with Article 50 of the Chemical Assessment Law.

In particular, enterprises that must register before December 31, 2021 (annual manufacturing import volume is more than 1000 tons or CMR substance is more than 1 ton) should first join the joint registration IT agreement body, and from now on, they can complete the registration procedures within the grace period by preparing LR selection and joint registration application documents on behalf of the registrant.

 

At the same time, the South Korea government has also issued an annex, that is, the joint registration needs to be completed by December 31, 2021, but there is currently no list of substances that do not operate smoothly on behalf of registrants and joint registration agreements. If you want to complete the joint registration before December 31, 2021, you need to take measures as soon as possible, such as selecting and representing the registrant LR, active participants and negative participants, forming a joint registration agreement, and meeting to determine the subsequent joint registration plan.

 

In fact, at the beginning of this year, many substances have begun to form joint registration agreements, and many substances have completed the selection of LR, active participants and negative participants on behalf of registrants. However, according to the list of attached substances published by the South Korea government, there are still 332 substances that have not completed the formation of the joint registration agreement body at present, representing the selection of the registrant LR. However, since the substances registered this time are aimed at the annual manufacture and import of more than 1000 tons and CMR substances, many test items are required, and according to relevant K-REACH regulations, the registration must be completed on behalf of the registrant LR, only other members of the protocol body can start the joint registration, so the cycle will be very long. At present, many manufacturers and traders of substances are holding a wait-and-see attitude, unwilling to be representative registrants, and unwilling to start joint registration early. South Korea the government's issuance of official documents this time also urges enterprises to start joint registration as soon as possible, otherwise there is a risk that joint registration of related substances cannot be completed on December 31, 2021.

If they decide to continue exporting the substances after 2021, they need to negotiate with other relevant enterprises as soon as possible, form an agreement body, select representative registrants, and start the subsequent joint registration work.
