Notice on Public Solicitation of Opinions on the Regulations on Environmental Protection and Management of Restricted Imported Solid Wastes as Raw Materials (2017) (Draft for Solicitation of Comments)

In order to implement the "Notice of the General Office of the State Council on Printing and Distributing the Implementation Plan for Prohibiting the Entry of Foreign Garbage and Promoting the Reform of the Solid Waste Import Management System" (Guo Ban Fa [2017] No. 70, hereinafter referred to as the "Implementation Plan"), and further strengthen the environmental management of imported solid waste To prevent environmental risks, the Ministry of Environmental Protection has issued the "Regulations on Environmental Protection and Management of Restricted Imports of Solid Wastes for Raw Materials (Announcement No, hereinafter referred to as the" Management Regulations (2015) ") has been revised. The main modifications are as follows:

The first is to implement the work requirements of "improving the solid waste import license system and canceling the import agency of trading units" in the "Implementation Plan", delete the relevant content of the "Administrative Regulations (2015)" concerning the import of entrusted agents, and clearly require that no other companies should be entrusted to import.

The second is to delete the contents of relevant waste varieties that have been transferred into the list of solid waste management prohibited from importing in the "Administrative Regulations (2015)", the extension of solid waste import license, the relevant contents of units that have received solid waste import license of the same variety in the past 3 years may be exempted from submitting corresponding certification materials, and the requirements that enterprises applying for importing waste should have the registration qualification of domestic consignees of solid waste that can be used as raw materials.

Third, according to the announcement of the Ministry of Commerce and the General Administration of Customs on canceling the examination and approval of processing trade business (Announcement No. 45 of 2016), the relevant requirements of "importing solid waste by way of processing trade" in the administrative provisions (2015) shall be located in the export processing zone, or have obtained the effective approval document for processing trade business issued by the competent department of commerce.

The fourth is to increase the information content of the enterprise's compliance with the law in the solid waste import license application form of the "Management Regulations (2015).
