Notes on Further Clarifying the Requirements for Declaring the Components of Dangerous Goods Mixtures Carried in and out of Waigaoqiao Waters

On February 8, 2022, our bureau published on its website the "Notes on Clarifying the Declaration Requirements for the Components of Dangerous Goods Mixtures Carried in and out of Waigaoqiao Waters" (related article:Explanation on Clarifying Requirements for Declaring Components of Dangerous Goods Mixtures Carried in and out of Waigaoqiao Waters). Recently, some enterprises have reported that some shipping companies still require complete component information in the booking process. In order to accurately implement the requirements of the second paragraph of Article 51 of the Yangtze River Protection Law, ensure the normal transportation of non-embargoed dangerous goods and support the normal production of enterprises, the relevant requirements are further clarified as follows:

1. The "prohibited goods" mentioned in this Note refers to the chemicals marked as "highly toxic" in the remarks column of the List of Hazardous Chemicals (2015 Edition) and the chemicals listed in the List of Hazardous Chemicals Bargoed in Inland Rivers (2019 Edition). According to the relevant requirements of Article 2 of the Guidelines for the Implementation of the Catalogue of Hazardous Chemicals (2015 Edition) (Trial), the CAS number is the only criterion for judging whether dangerous goods belong to the scope of prohibited goods.

2. ship-borne container dangerous goods intended to enter, exit, transit and transit through Waigaoqiao Port Area, if they are mixtures, the MSDS provided when handling dangerous goods declaration procedures is recommended to display complete component information, which should include the name, proportion and CAS number of each component.

3. For mixtures that show complete component information in the MSDS, the embargo requirements are as follows:

(I) if all components do not fall within the scope of embargoed goods, they are treated as non-embargoed goods;

(II) mixtures with some components falling within the scope of embargoed goods, three GHS category indicators are required: "Health Hazard-Acute Toxicity Category", "Hazard to the Aquatic Environment-Acute Toxicity Category" and "Hazard to the Aquatic Environment-Long-Term Hazard Category. If none of the three indicators reaches category 1, it is handled as non-embargoed goods.

One of the three indicators belongs to category 1, which falls within the scope of embargoed goods and is not allowed to enter, exit, transit and transit through Waigaoqiao Port Area.;

4. For mixtures that do not show complete composition information in the MSDS, the following requirements are imposed for embargoed:

(I) provide three GHS category indicators of "Health Hazard-Acute Toxicity Category", "Hazard Aquatic Environment-Acute Toxicity Hazard Category" and "Hazard Aquatic Environment-Long-term Hazard Category". If the three indicators do not reach category 1, they shall be handled as non-embargoed goods;

If one of the three indicators of the (II) reaches category 1, it is necessary to complete all relevant hazardous component information that causes the mixture to reach hazard category 1, including component name, CAS number and concentration range. This requirement is not limited by 3.3.2 "Mixtures"-Table 1 "Concentration Limits of Health and Environmental Hazardous Components of Mixtures" in Guidelines for Preparation of Chemical Safety Technical Instructions (GB/T 17519-2013).

If the above-mentioned hazardous ingredient information contains components that fall within the scope of embargoed goods, they fall within the scope of embargoed goods and are not allowed to enter, exit, transit and transit through the Waigaoqiao port area.

5. the "GHS category indicators" and "information on relevant hazardous components" mentioned in the third and fourth items above can be provided by providing a written guarantee at the time of declaration, and there is no need to revise the MSDS.

6. The five requirements of 4. 2 and 3. of this Note apply only to ship-borne dangerous cargo mixtures and not to cargo identified as "substances" (Substance) in Part 3 of the MSDS.

7., for enterprises in need, our bureau provides pre-check and publicity services. Enterprises can submit relevant technical data to our bureau in advance. For those that do not fall within the scope of embargoed goods after examination, our bureau will publicize them on the website.
