This time, the "Safety Production Law" has been revised with great intensity and involves many provisions, which has greatly improved the safety production law. Further clarify the responsibility for production safety in all aspects, and establish a set of relatively perfect responsibility system.
The "National Three-Year Action Plan for Special Rectification of Work Safety" pointed out: "Establish a full responsibility system for work safety. Enterprises should establish and improve the safety production responsibility system covering all management and operation positions from the main person in charge to the front-line employees, and clarify the safety production responsibilities of all personnel in the enterprise. Strengthen the education of the rule of law in production safety, improve the consciousness of all employees to abide by the law, establish an endogenous mechanism of self-restraint and continuous improvement in production safety, establish an internal safety production supervision and assessment mechanism, and promote the implementation of safety production responsibilities in various positions."
To sum up, the safety production responsibility system is the establishment and implementation of all staff safety production responsibilities and the operation system of the relationship between responsibilities. The safety production responsibility system refers to the list of responsibilities of the full safety production responsibility system with the responsibilities of the first responsible person as the source, forming a dynamic responsibility assessment mechanism that is organically combined with daily safety production management.
1. Implement the "Three Must" and Build a Secure Defense Line
At the press conference of the State Council Information Office, Song Yuanming, deputy director of the Emergency Management Department, introduced that this revision of the Work Safety Law will be written into the "three must" principles that the industry must manage safety, the business must manage safety, and the production and operation must manage safety. law.
The principle of "three must" was first put forward by General Secretary Xi Jinping when he inspected the scene of the deflagration accident caused by the oil pipeline leakage in Sinopec Huangdao Economic Development Zone in 2013. Mainly to solve the problem of safety supervision system, it is required that in 2020, the safety production supervision system is basically mature.
Regarding the management of government departments, Article 10 of the New Security Law states that "relevant departments such as transportation, housing and urban and rural construction, water conservancy, civil aviation, etc. shall, in accordance with the provisions of this law and other relevant laws and administrative regulations, conduct relevant industries within their respective responsibilities., Implement supervision and management of work safety in the field". This department is generally called the competent department in the industry field, which requires safety when it is in charge of business and production and operation activities.
The new safety law also clarifies the safety responsibilities of the person in charge of the enterprise. For example, it is pointed out in Article 5 that "the main person in charge is the first person responsible for production safety" and "other persons in charge are responsible for production safety within the scope of their duties".
Except for the main person in charge who is the first responsible person in the enterprise, other deputy positions must bear certain responsibilities and responsibilities for safety production work according to the business in charge. The deputy general manager in charge of human resources shall be responsible for the safety of the field in charge. In subordinate enterprises, the safety management team is not in place and there is a shortage of people, and the deputy position should be responsible for the resulting accidents. The deputy general manager in charge of finance, if the safety investment in the subordinate enterprise is not in place, the deputy general manager in charge of finance shall bear the responsibility.
Of course, functional departments must also cooperate with each other. The revised Work Safety Law stipulates that departments responsible for safety supervision must cooperate with each other, jointly manage, share information, and share resources, so that safety supervision can be strengthened in accordance with the law., So that departments have clear responsibilities and joint management, forming a joint force of supervision.
The three must be the principles of division of labor and responsibility in our national production safety management system. In other words, the implementation of safety management responsibilities in accordance with the principles of the same responsibility of the party and government, two responsibilities for one post, and joint management, requires all industries, fields, departments and all their personnel to be responsible for safety production within the scope of their work responsibilities.
2. Division of departmental responsibilities
According to the principle of "three must", there are two types of government safety supervision departments in the safety production law, one is the emergency management department, and the other is the competent department of other industries, which is called the relevant department. The two types of departments are collectively referred to as the departments responsible for the supervision and management of production safety.
Article 10 of the new security law proposes two kinds of supervision and management, one is the "comprehensive supervision and management" responsible by the emergency management department, and the other is the "supervision and management" responsible by the relevant departments ". The two types of regulation stem from the comprehensive regulation and industry regulation proposed in Article (V) of the Central Committee's Opinions.
"Supervision and management" and "industry supervision" belong to direct supervision, and comprehensive supervision belongs to indirect supervision, that is, supervision through direct supervision departments. The new security law points out that "transportation, housing and urban and rural construction, water conservancy, civil aviation and other relevant departments" are the direct supervision departments, and the key is the scope of "waiting". According to the three departments in charge of industry, business, production and operation that must be put forward, it should also include the departments in charge of education, health, sports, culture, agriculture, forestry, commerce, urban management and industry; departments in charge of environmental protection, special equipment, food and drugs, land and resources, etc.
As a comprehensive supervision department, the emergency management department also has direct supervision of industries, such as metallurgy, nonferrous metals, building materials, light industry, textile, machinery, tobacco, commerce and trade, as well as hazardous chemicals, fireworks and firecrackers.
3. Specific division of labor at all levels of government
The principle stipulates that the local people's governments at or above the county level shall determine the supervision and management departments in accordance with the principle of similar business, so as to prevent the blind area of safety supervision formed by mutual responsibility between departments.
Due to the complexity of our country's management system and the continuous progress of system reform, it is difficult to have a specific and clear division of labor between departments. Taking into account some unclear responsibilities, the new safety law adds Article 15, which requires that "people's governments at or above the county level shall organize departments responsible for the supervision and management of production safety to prepare a list of rights and responsibilities for safety in accordance with the law."
4. Mandatory national standard division of labor
In line with the reform of China's standardization system, the new safety law adds Article 12, which proposes the division of labor of compulsory national standards for production safety. That is, the relevant departments put forward and technical review, etc., the emergency management department to coordinate the project plan, the standard department in charge of the project, number and release. This has corrected the current phenomenon of multiple administrations in standardization work.
5. Requirements for development zones, industrial parks, port areas and scenic spots
Article 9 of the New Safety Law adds the requirements of development zones, port areas, and scenic spots to the original responsibilities of township governments and offices. "The relevant working institutions responsible for the supervision and management of production safety and their responsibilities shall be clearly defined, including the" supervision and inspection "of enterprises. Assist superiors or themselves to perform safety supervision duties in accordance with their authorization.
The most important safety in this type of area is the chemical park. These parks have concentrated risks, heavy safety management tasks, and government supervision is indispensable. Here, it is also the responsibility of the government to determine the weak link of the current safety supervision of the chemical park.
6. Full safety production responsibility system
One of the highlights of this revision of the Safety Production Law is to further consolidate the main responsibility of production safety of production and business units. Production and business units implement the full safety responsibility system, and every department, every post, and every employee directly or indirectly affects safety production to varying degrees. Safety production everyone is the protagonist, no bystanders. This revision of the new regulations on the safety responsibility system for all employees is to mobilize the enthusiasm and creativity of all employees in production and business units, so as to form a situation in which everyone cares about safety in production, everyone improves safety quality, and everyone does a good job in safety in production, so as to improve the level of safety in production as a whole.
