Recently, the Emergency Management Department issued the "Measures for the Safety Guarantee Responsibility System for Major Hazard Sources of Hazardous Chemical Enterprises (Trial)" (draft for comments) and drafting instructions and public comments. The draft for soliciting opinions includes general principles, guarantee responsibilities, management measures, supervision and inspection, and supplementary provisions, with a total of five chapters and 15 articles. The first chapter is the general rules, clear scope of application and overall requirements. The second chapter is the responsibility of guarantee, which lists that the three persons responsible for the safety guarantee have five responsibilities for the safety production of major hazard sources. The third chapter is the management measures, requiring the person responsible for the safety guarantee of major hazard sources to be publicized in the factory area and the monitoring and early warning system as the first push object of risk early warning information; Establish performance records and promise to announce the risk control situation to the society every day. The fourth chapter is supervision and inspection, requiring emergency departments to use monitoring and early warning systems to strengthen online inspections and spot checks on the safe operation of major hazard sources; the implementation of the safety guarantee responsibility system for major hazard sources is included in the scope of law enforcement inspections. The fifth chapter is the supplementary provisions, clear the implementation time.

Measures for the Safety Guarantee Responsibility System for Major Hazard Sources of Hazardous Chemical Enterprises (for Trial Implementation) (Draft for Solicitation of Comments)
Chapter I General Provisions
Article 1 in order to strengthen the implementation of the main responsibility for production safety of hazardous chemical enterprises, refine the responsibility for major risk management and control, and prevent major accidents, these measures are formulated in accordance with laws, regulations and rules such as the production Safety Law, the regulations on the Safety Management of Hazardous Chemicals, and the interim provisions on the Supervision and Administration of Major Hazard sources of Hazardous Chemicals.
Article 2 These Measures shall apply to the production and operation (with storage) enterprises of hazardous chemicals that involve major hazardous sources of hazardous chemicals (hereinafter referred to as major hazardous sources), and chemical enterprises that use hazardous chemicals to engage in production (hereinafter referred to as hazardous chemicals Enterprises), excluding the headquarters of group companies without production entities.
Article 3 Each major hazard source of a hazardous chemical enterprise shall specify the three responsible persons: the main person in charge, the technical person in charge, and the person in charge of the operation, and implement safety guarantees for major hazard sources from the three levels of overall, technical, and operational.
Chapter II Guarantee Liability
Article 4 The main person in charge refers to the actual controller of the enterprise (such as the legal representative, chairman, general manager, or the actual person in charge of comprehensively organizing and leading the production and operation activities of the enterprise), who has the following safety guarantee responsibilities for the major hazard sources of the unit:
(I) organize the establishment of safety guarantee responsibility system for major hazard installations and specify the technical person in charge and operation person in charge who is responsible for safety guarantee for major hazard installations;
(II) organize the formulation of safety production rules and regulations and operating procedures for major hazard installations, and take effective measures to ensure their implementation;
(III) organize the training of safety operation skills for the personnel in the management and operation posts of major hazard installations, so as to ensure the necessary safety input for the safe production of major hazard installations;
(IV) organize to formulate and implement the emergency rescue plan for major hazard source accidents;
(V) organize the construction of the unit's hazardous chemical safety production risk monitoring and early warning system to ensure that the relevant data of major hazard sources are connected to the system and operate effectively.
Article 5 The technical person in charge refers to the person in charge of technology, production, equipment, etc. at the level of the company or branch factory, who has the following responsibilities for the major hazard sources guaranteed:
(I) organize and implement the construction of safety monitoring and control system for major hazard installations, improve control measures, and ensure compliance with national standards or industry standards;
(II) organize regular inspection and inspection of safety facilities and monitoring and control system, and carry out regular maintenance to ensure effective and reliable operation;
(III) the organization to determine the personal and social risk values of major hazard sources, and take corresponding risk reduction measures for those exceeding the limit standards;
(IV) organize to review relevant qualifications, safety management organization, safety management system and safety education of external construction units and personnel involved in major hazard sources;
The (V) organizes at least one targeted safety risk investigation for major hazard sources every quarter. Safety risk investigation must be carried out before major activities, key periods and holidays, and control measures and governance plans must be formulated and supervised.
Article 6 The person in charge of operation refers to the direct management personnel (such as workshop director) of the grass-roots workshop and unit where the major hazard source production unit and storage unit are located, who shall have the following responsibilities for the major hazard source guaranteed:
The (I) is responsible for urging each post to strictly implement the safety production rules and regulations and operation procedures for major hazard sources;
(II) supervise and inspect the special operations, inspection and maintenance operations involving major hazard sources, and urge the implementation of operation safety control measures;
(III) organize to drill the special emergency plan and site disposal plan for major hazard sources in accordance with relevant requirements;
The (IV) shall organize safety risk investigation of major hazard sources at least once a week, and organize (request) to take timely measures to eliminate accident hazards;
The (V) shall organize the process, equipment and other relevant professionals to conduct professional inspection on major hazard sources every day.
Chapter III Management Measures
Article 7 A hazardous chemical enterprise shall add a public notice board at the position of the safety warning sign of a major hazard source, stating the three persons responsible for the safety guarantee and their corresponding responsibilities, namely, the main person in charge, the technical person in charge, and the person in charge of the operation, open the telephone and accept the supervision of employees.
The person responsible for the safety guarantee of major hazard sources, responsibilities, and contact information shall be entered into the hazardous chemical safety production risk monitoring and early warning system, and report to the local emergency management department in the corresponding major hazard source information. After the relevant information is changed, it shall be within 2 days Update in the hazardous chemical safety production risk monitoring and early warning system.
Article 8 A hazardous chemical enterprise shall, in accordance with the relevant requirements of the Notice of the Ministry of Emergency Management on the Full Implementation of the Safety Risk Evaluation and Commitment Announcement System for Hazardous Chemical Enterprises (Emergency [2018] No. 74), make a commitment to announce the safety risk management and control of major hazard sources to the society after reporting to the main person in charge level by level every day.
Article 9 A hazardous chemical enterprise shall, in accordance with the requirements for the safety guarantee of major hazard sources, establish the performance records of the main person in charge, the technical person in charge, and the person in charge of the operation, so that they can be queried and traced, and included in the assessment of the enterprise's safety production responsibility system.
Article 10 Local emergency management departments at all levels shall improve the working mechanism of the risk monitoring and early warning system for the safety production of hazardous chemicals, and the early warning information of major hazard sources shall be first pushed to the person responsible for safety guarantee.
Article 11 Emergency management departments at all levels and hazardous chemical enterprises shall, in combination with the construction of safety risk classification control and hidden danger investigation and management system, develop information-based intelligent management tools and strengthen the safety management of major hazard sources.
Chapter IV Supervision and Inspection
Article 12 Local emergency management departments at all levels shall use the risk monitoring and early warning system for the safe production of hazardous chemicals to strengthen online inspections and spot checks on the safe operation of major hazard sources, and incorporate the implementation of the safety guarantee responsibility system for major hazard sources into the scope of law enforcement inspection.
Article 13 If a hazardous chemical enterprise fails to monitor and monitor the safety of major hazard sources in accordance with relevant requirements, fails to specify the responsible persons of key devices and key parts of major hazard sources, fails to regularly inspect the safety production status of major hazard sources, takes measures to eliminate hidden dangers of accidents, and has other violations of laws and regulations, the emergency management department at or above the county level shall impose penalties in accordance with laws and regulations; if the responsible person constitutes a crime, investigate criminal responsibility according to law.
Article 14 Local emergency management departments at all levels shall strengthen the supervision and inspection of hazardous chemical enterprises with major hazard sources, urge relevant enterprises to do a good job in the identification, evaluation, filing and verification of major hazard sources, and fill in relevant information on major hazard sources through the registration information management system of hazardous chemicals in a timely manner.
Chapter V Supplementary Provisions
Article 15 These Measures shall enter into force as of the date of issuance. Notice of the Ministry of Emergency Management on the Implementation of the Responsibility System for Major Hazardous Sources of Hazardous Chemicals (Emergency [2018] No. 89) shall be repealed simultaneously.
