Access regulations and standards

Before exporting or importing chemicals to China, companies need to know whether chemicals need to be registered, whether they need a business license or import license, and whether these chemicals have been banned and restricted in China. It is necessary to judge whether it is new chemical substances, hazardous chemicals, strictly restricted import and export of toxic chemicals, precursor chemicals, controlled ozone-depleting substances in China, etc., and make corresponding registration or license in advance.

Provide complete and accurate customs declaration documents

According to the "Regulations on the Safety Management of Hazardous Chemicals" (Order No. 591 of the State Council), the customs is responsible for the inspection of imported and exported hazardous chemicals and their packaging. The Announcement on Issues Relating to the Inspection and Supervision of Imported and Exported Hazardous Chemicals and Their Packaging (General Administration of Customs Announcement No. 129 of 2020) stipulates that the Customs shall carry out inspection of imported and exported hazardous chemicals listed in the National Catalogue of Hazardous Chemicals (latest edition). Therefore, for the import and export of dangerous chemicals, belong to China's legal inspection of goods.

Announcement No. 29 of 2023 of the General Administration of Customs (Announcement on Further Strengthening the Inspection and Supervision of Imported Hazardous Chemicals) implements the mode of "port inspection or destination inspection for document verification" for batch approval of imported hazardous chemicals, and sets the inspection operation links (locations) and proportions according to the attributes of imported hazardous chemicals and the packaging types of dangerous goods.

When the consignee or agent of the imported dangerous chemicals declares, he shall truthfully fill in the attributes of the goods, the name of inspection and quarantine, the dangerous category, the packaging category, the United Nations dangerous goods number (UN number), the packaging mark of the dangerous goods (UN mark of the packaging) and the inspection and quarantine authority of the destination in the "China International Trade Single Window, and in accordance with the declared goods, upload the relevant materials required by the General Administration of Customs Announcement No. 129 of 2020 (Announcement on Issues Related to the Inspection and Supervision of Import and Export of Hazardous Chemicals and Their Packaging).

In addition, enterprises also need to pay attention to the updated declaration specification for documents attached to imported hazardous chemicals from March 31, 2023, and fill in according to the specification requirements.

Reporting of Imported Hazardous Chemicals

When the consignee of imported dangerous chemicals or his agent declares customs, the items to be filled in shall include the dangerous category, packaging category (except bulk products), United Nations dangerous goods number (UN number), United Nations dangerous goods packaging mark (packaging UN mark) (except bulk products), etc., and the following materials shall also be provided:

(I) the Declaration of Conformity of Enterprises Importing Hazardous Chemicals;

The (II) shall provide the description of the name and quantity of the inhibitor or stabilizer actually added for the product to which the inhibitor or stabilizer needs to be added;

(III) Chinese hazard publicity labels (except bulk products, the same below), Chinese safety data sheet samples.

Reporting of Exported Hazardous Chemicals

The consignor or his agent who exports dangerous chemicals shall provide the following materials when reporting to the Customs for inspection:

(I) the Declaration of Conformity of Production Enterprises of Export Hazardous Chemicals;

(II) of the Outbound Cargo Transport Package Performance Inspection Results Sheet (except for bulk products and international regulations exempt from the use of dangerous goods packaging);

Classification and identification report of (III) hazard characteristics;

(IV) hazard publicity labels (except bulk products, the same below), safety data sheet samples, if it is a foreign language sample, should provide the corresponding Chinese translation;

The (V) shall provide the description of the name and quantity of the inhibitor or stabilizer actually added for the product requiring the addition of the inhibitor or stabilizer.

The inspection of import and export dangerous chemicals includes:

(I) whether the main ingredients/component information, physical and chemical characteristics, hazard categories, etc. of the product comply with the provisions of Article 4 of this Announcement.

(II) whether there is a danger publicity label on the product package (imported products should have a Chinese danger publicity label) and whether it is accompanied by a safety data sheet (imported products should be accompanied by a Chinese safety data sheet); Whether the contents of the danger publicity label and safety data sheet conform to the provisions of Article 4 of this announcement.

For the packaging used for imported hazardous chemicals, the packaging type, packaging mark, packaging category, packaging specification, single piece weight, packaging use status, etc. shall be inspected to see if they comply with the provisions of Article 4 of this Announcement.

For the packaging of export dangerous chemicals, performance inspection and use appraisal shall be carried out in accordance with the regulations and standards for the inspection and management of the packaging of export dangerous goods transported by sea, air, road and railway, and the "Outbound Goods Transport Packaging Performance Inspection Results Sheet" and "Outbound Dangerous Goods Transport Packaging Use Appraisal Results Sheet" shall be issued respectively.

The import and export of hazardous chemicals used as food and food additives shall comply with relevant food safety regulations.

Packaging identification and suitable transportation mode and route

Dangerous goods must be properly marked and packed during transport. The mode and route of transport of imported dangerous goods must comply with the requirements of relevant regulations and standards. When choosing the mode and route of transportation, the nature, quantity, transportation distance and delivery time of dangerous goods must be fully considered. At the same time, it is also necessary to ensure the safety and reliability of dangerous goods during transportation.

Waste treatment

Waste may be produced in the process of export and use of dangerous goods, and enterprises must deal with it correctly. Waste disposal should be carried out in compliance with national regulations or policies to minimize environmental and human impacts. Enterprises should establish a waste management system, develop a waste treatment plan, and select a professional organization with compliance certification for treatment.
