Environmental emergency plan refers to the work plan formulated in advance by the enterprise to take emergency measures in response to various accidents and natural disasters to avoid or minimize the entry of pollutants or other toxic and harmful substances into the atmosphere, water, soil and other environmental media outside the plant boundary. This kind of plan is different from other emergency plans such as production safety accidents, fire fighting, health and so on, so as to facilitate the implementation and management of enterprises and environmental protection departments.

Why is it necessary to prepare an environmental emergency plan?
Article 47 of my country's "Environmental Protection Law" stipulates that enterprises and institutions shall formulate emergency plans for environmental emergencies in accordance with relevant national regulations and report them to the competent environmental protection department and relevant departments for the record. When an environmental emergency occurs or is likely to occur, enterprises and institutions shall take immediate measures to deal with it, promptly notify the units and residents that may be endangered, and report to the competent environmental protection department and relevant departments.
The "Administrative Measures for the Filing of Emergency Plans for Environmental Emergencies in Enterprises and Institutions (Trial)" (Huanfa [2015] No. 4) mentioned that in order to respond to various accidents and natural disasters, enterprises take emergency measures to avoid or minimize The work plan formulated in advance by pollutants or other toxic and harmful substances entering the atmosphere, water, soil and other environmental media outside the plant boundary.
Article 6 of the former Ministry of Environmental Protection's "Emergency Management Measures for Environmental Emergencies" (implemented on June 5, 2015) stipulates that enterprises and institutions shall perform the following obligations in accordance with the requirements of relevant laws, regulations and standards:
Ø Conduct risk assessment of environmental emergencies;
Ø Improve the risk prevention and control measures for environmental emergencies;
Ø Investigate and manage potential environmental safety hazards;
Ø Formulate emergency plan for environmental emergencies and put it on record and drill;
Ø Strengthen the construction of environmental emergency response capacity guarantee.
Ø When an environmental emergency occurs or is likely to occur, enterprises and institutions shall handle it in accordance with the law and be liable for the damage caused.
2. Which enterprises should make environmental emergency plans?
According to Article 3 of document UNCED [2015] No. 4 issued by the former Ministry of Environmental Protection on January 8, 2015, these measures shall apply to the guidance and management of the filing of environmental emergency plans of the following enterprises:
Pollutant discharge enterprises that may have environmental emergencies, including enterprises operating centralized sewage and domestic waste treatment facilities;
Enterprises that produce, store, transport and use hazardous chemicals;
Enterprises that produce, collect, store, transport, utilize and dispose of hazardous wastes;
Tailings reservoir enterprises, including wet storage industrial waste reservoir, power plant ash reservoir enterprises;
Other enterprises that should be included in the scope of application.
These Measures shall not apply to the filing of the emergency plan for nuclear and radiation environment.
The provincial environmental protection department may, according to the actual situation, issue a directory of enterprises that should be put on record for environmental emergency plans in accordance with the law.
3. Who will prepare the environmental emergency plan?
Article 8 of the measures for the filing and Management of Emergency Plans for Environmental Emergencies in Enterprises and institutions (for trial implementation) (Huanfa [2015] No. 4) stipulates that enterprises are the main body responsible for the formulation of environmental emergency plans, according to the needs of dealing with environmental emergencies, carry out the formulation of environmental emergency plans, and be responsible for the authenticity and maneuverability of the contents of environmental emergency plans.
Enterprises may prepare their own environmental emergency plans, or entrust relevant professional and technical service institutions to prepare environmental emergency plans. If the relevant professional and technical service institutions are entrusted to prepare, the enterprise shall designate relevant personnel to participate in the whole process.
4. How to prepare environmental emergency plan
Ø Establish an environmental emergency plan preparation team, and clarify the composition of the preparation team leader and members, work tasks, preparation plan and budget;
Ø Conduct environmental risk assessment and emergency resource survey. Environmental risk assessment includes but is not limited to: analyzing the law of various accidents, the degree of impact of natural disasters, identifying environmental hazards, analyzing the relationship with the surrounding residents, units, and regional environment that may be affected, constructing environmental emergencies and their consequences, and determining environmental risk levels. The investigation of emergency resources includes but not limited to: investigating the situation of emergency resources such as environmental emergency teams, equipment, materials and places that can be called by the enterprise at the first time and the situation of emergency resources that can request assistance or agreement assistance;
Ø Prepare environmental emergency plan. Reasonably select categories, determine content, and focus on the disposal measures that need to be taken under the scenario of possible environmental emergencies, the content and methods of notification to the residents and units that may be affected, and the content and methods of reporting to the environmental protection department and relevant departments, And the connection with the government plan to form an environmental emergency plan. During the preparation process, the opinions of employees and representatives of residents and units that may be affected shall be solicited;
Ø Review and drill the environmental emergency plan. The enterprise shall organize experts and representatives of residents and units that may be affected to review the environmental emergency plan and carry out drills for inspection;
Ø The review experts shall generally include personnel of relevant government management departments involved in the environmental emergency plan, representatives of relevant industry associations, and personnel with experience in relevant fields.
5. Basic framework of emergency plan
Ø Brief introduction of the emergency plan, specifying the preparation purpose, scope of application, text management and revision conditions of the emergency plan;
Ø Overview of the basic situation of the unit and the surrounding environment, explaining the basic situation of the unit and the basic situation of its operating facilities and the surrounding environment;
Ø The situation of starting the emergency plan, the risk analysis of the possible accidents of the unit, and the conditions and standards for starting the emergency plan. Including: accident identification; hazard analysis of hazardous substances; analysis and evaluation of environmental risk accident scenarios; the situation of starting the plan;
Ø Emergency organization, specifying the organization, personnel and responsibilities of emergency organization, and external emergency/rescue force;
Emergency response procedures-accident discovery and alarm (when an emergency is found), clear the measures to be taken when an accident is found, and relevant procedures, methods, time limit requirements, contents, etc. for alarm, help, report, etc. Clarify which states should report to external emergency/rescue forces and request support, and which states should alert and notify neighboring units and personnel;
Emergency response procedures-accident control (emergency control phase), specifying the specific actions to be taken by emergency agencies after an accident occurs. Including response classification, alert security, emergency monitoring, on-site disposal, emergency response termination procedures, etc;
Emergency response procedures-follow-up matters (post-emergency control stage), clear the work content after the accident is controlled. Such as organizing late pollution monitoring and treatment; ensuring that no waste treatment, storage or disposal activities incompatible with the nature of the leaked materials are carried out in the affected area, ensuring that all emergency equipment is cleaned and restored to its original functions before resuming production and other safety measures;
Personnel safety first aid, clear emergency state, the wounded on-site first aid, safe transfer, personnel evacuation and personnel protection in the hazard area. The evacuation plan shall specify the conditions under which evacuation should be recommended;
Emergency equipment, list emergency equipment, facilities and equipment, including type, name, quantity, storage location, specifications, performance, use and usage information;
Emergency prevention and safeguard measures, clear accident prevention and emergency support plan; emergency training and exercise provisions.
Ø Accident report, stipulating the time limit, procedure, method and content of reporting accidents to government departments or other external departments;
Ø Press release of the accident, and make clear the press release plan of the accident;
Ø The implementation and effective time of the emergency plan, and specify the implementation and effective time of the emergency plan;
Ø Annexes to provide necessary technical support information for emergency response activities;
6. Key points of preparation of emergency plan
Accident identification, emergency plan must carry out accident identification, clear what state should start the emergency plan, what state should request external support, what state should be recommended to evacuate the plant and other decision-making key points and decision criteria. Overflow, fire and explosion are the most typical accidents that may threaten the environment, property and personal safety, and need to be correctly identified. In addition, the risk of accidents caused by human error should also be noted;
Emergency coordinator, formulate the primary emergency coordinator and formulate the standby emergency coordinator. The emergency coordinator must undergo professional training, have corresponding knowledge and skills, and be familiar with the situation of the unit. The company shall give the emergency coordinator the right to mobilize personnel, equipment, funds and coordinate all emergency response measures to implement the emergency plan, and there must be one person resident in the unit to deal with the emergency during normal operation;
Emergency equipment, basic emergency equipment mainly includes internal communication or alarm system (with instructions for use), facilities requesting external support (such as telephone), fire fighting equipment, fire control equipment, overflow control equipment, pollution elimination equipment, emergency medical rescue equipment and drugs, emergency personnel safety protection equipment (such as protective clothing, gas masks), etc;
The evacuation plan and emergency plan shall specify the signal mode, evacuation route and alternative route for starting evacuation, and post the location map in key areas to mark the evacuation route and the location of the nearest emergency equipment;
Ø Government reports that units that cause serious environmental pollution by hazardous waste due to accidents or other emergencies must report to the government environmental protection department and other relevant departments;
Ø Plan revision, found that the emergency plan has deficiencies and defects, or even complete failure, to be revised in a timely manner. In addition, the emergency plan shall be revised in time when the following changes occur:
-Changes in applicable laws and regulations;
-Changes in the design, construction, operation and maintenance of operating facilities;
-Changes in other conditions that may result in an increased risk;
-Change of emergency coordinator;
-Change of emergency equipment;
-Changes in emergency response techniques and capabilities;
-Each production team and production post changes;
7. Revision of environmental emergency plan
Article 12 of the measures for the filing and Management of Emergency plans for Environmental Emergencies in Enterprises and institutions (for trial implementation) (Huanfa [2015] No. 4) stipulates that enterprises, in the light of the implementation of environmental emergency plans, conduct a retrospective assessment of environmental emergency plans at least once every three years. Under any of the following circumstances, the amendment shall be made in a timely manner:
Ø Major changes in the environmental risks faced and a new environmental risk assessment is required;
Ø Major changes in the emergency management organization and command system and responsibilities;
Ø Major changes have taken place in the environmental emergency monitoring, early warning and reporting mechanism, response processes and measures, and emergency safeguard measures;
Ø Significant changes in important emergency response resources;
Ø Problems are found in the actual response to emergencies and emergency drills, and major adjustments need to be made to the environmental emergency plan;
Ø Other circumstances that need to be revised;
Ø In case of major revision of the environmental emergency plan, the revision shall be carried out with reference to the formulation steps of the environmental emergency plan. If the individual contents of the environmental emergency plan are adjusted, the revision work may be appropriately simplified.
8. What are the materials submitted for the filing of environmental emergency plans
Ø Contingency Plan for Environmental Emergencies;
Ø Paper documents and electronic documents of environmental emergency plan and preparation instructions. Environmental emergency plan includes: signing and issuing documents of environmental emergency plan and text of environmental emergency plan; Preparation instructions include: overview of preparation process, description of key contents, explanation of soliciting opinions and adoption, and explanation of evaluation;
Ø Paper and electronic documents of the environmental risk assessment report;
Ø Paper and electronic documents of environmental emergency resources investigation report;
Ø Paper documents and electronic documents of environmental emergency plan review opinions;
Ø If there is a major revision of the enterprise's environmental emergency plan, it shall, within 20 working days from the date of issuance, file the change with the original accepting department.
9. The completion of the preparation of the emergency plan and the filing with the environmental protection department mean the end of the work?
At that time, it was not. In the following production process, enterprises need to carry out relevant training and exercises according to the emergency plan, so that timely and effective emergency response can be made in case of environmental emergencies.
10. What penalties will the enterprise receive if it fails to comply with the requirements of the emergency plan?
According to Article 38 of the measures for Emergency Management of Environmental Emergencies, if an enterprise or institution has one of the following circumstances, the competent department of environmental protection at or above the county level shall order it to make corrections and may impose a fine of not less than 10,000 yuan but not more than 30,000 yuan:
The (I) fails to carry out the risk assessment of environmental emergencies and determine the risk level;
The (II) fails to carry out the investigation and treatment of environmental safety hazards as required, and establish the investigation and treatment files of hidden dangers;
The (III) fails to put on record the emergency plan for environmental emergencies as required;
The (IV) fails to carry out emergency training for environmental emergencies and truthfully record the training;
The (V) fails to reserve necessary environmental emergency equipment and materials as required;
The (VI) fails to disclose the relevant information of environmental emergencies as required.
