Analysis on the Key Points of "Cosmetic Labeling Management Measures"
"Cosmetic labeling management approach" (hereinafter referred to as the "measures") has been officially released on June 3, 2021. Please see the end of the article for the original text.
1. Transitional period
"Measures" pointed out that since May 1, 2022, apply for registration or filing of cosmetics, must comply with the provisions and requirements of the "measures"; Prior to the application for registration or filing of cosmetics, not in accordance with the provisions of the "measures" for labeling, cosmetics registration, filing must be in 2023 May 1 recently completed product labeling update, so that it meets the provisions and requirements of the "measures".
2. The content of ≤ 0.1% shall be identified as trace component

The cosmetic label shall mark the raw material standard Chinese name of all the ingredients of the cosmetic in the visual surface of the sales package, with the "ingredient" as the leading word and list in descending order of the content of each ingredient in the product formulation. Where not more than 0.1%(w/w) of the ingredients are present in the cosmetic formulation, all not more than 0.1%(w/w) of the ingredients shall be separately labeled with "Other trace ingredients" as the introductory phrase and may not be listed in descending order of ingredient content.
In the form of compound or mixed raw materials to fill in the formula, it shall be based on the content of each component in the formula as the basis of the content of the components to sort and determine whether the trace components.
3. New method for marking product service life
Labeling method: In addition to the two conventional methods of "Production Date and Shelf-life" and "Production BatchNo. and Date of Limited Use", a new method of labeling "Production BatchNo. and Use Period after Kaifeng" can be added.
The "measures" stipulates that only products with outer packing boxes can use this labeling method on packaging containers that directly contact the contents, but the outer packing boxes can only choose to label "production date and shelf life" or "production batch number and the date of limited use".
4. Non-sales goods and Chinese labeling requirements

These Measures shall be applicable to the labeling of cosmetics provided to consumers in the form of free trial, gift and exchange. That is, after the implementation of the new rules, the labeling requirements for cosmetics that are given, given and exchanged for free are equivalent to the labeling requirements for products sold, without any exemption conditions.
The Measures further state that cosmetics should have a Chinese label, which includes at least ten items such as the product's Chinese name, the name and address of the registrant/filer, total composition, net content, and service life. For products with packaging boxes, the Chinese name and the service life of the product shall be marked on the packaging container which is in direct contact with the contents. This has a greater impact on imported cosmetics.
5.Provisions on the use of trade names
The "measures" article eighth of the trademark name, common name and attribute name made the prescribed requirements. For example, a medical effect or an effect that the product does not have may not be claimed in trade name form. Use terms that imply the presence of a class of ingredients as trade names. Enterprises should do a good job in product name compliance work according to the requirements.

Announcement of the State Food and Drug Administration on Issuing and Implementing the Measures for the Administration of Cosmetic Labeling (No.77 of 2021)
In order to strengthen the supervision and management of cosmetics labels, standardize the use of cosmetics labels and protect the legitimate rights and interests of consumers, the State Food and Drug Administration has organized and drafted the Measures for the Administration of Cosmetic Labels (hereinafter referred to as the Measures), which are hereby promulgated. The relevant matters concerning the implementation of the Measures are hereby announced as follows:
Encourage cosmetics registrants and filers to label cosmetics according to the Measures from the date of this announcement. Since May 1, 2022, cosmetics that apply for registration or filing must comply with the provisions and requirements of the Measures; If cosmetics that have previously applied for registration or filing have not been labeled in accordance with the provisions of the Measures, the registrants and filers of cosmetics must update the product labels before May 1, 2023, so as to meet the provisions and requirements of the Measures.
