Announcement on the transitional treatment rules of five kinds of special-purpose cosmetics such as hair growth

According to the announcement (No.144 of 2020) of the State Food and Drug Administration on the implementation of the Regulations on the Supervision and Administration of Cosmetics, since January 1, 2021, special-purpose cosmetics such as hair growth, hair removal, beauty care, bodybuilding and deodorization as stipulated in the Regulations on Cosmetic Hygiene Supervision are no longer managed according to special cosmetics, and the State Drug Administration will no longer accept applications for registration of related products and issue administrative license documents for related special-purpose cosmetics. The State Drug Administration shall terminate the examination and approval of products that are ordinary cosmetics or not cosmetics according to the Regulations; According to the "Regulations", products belonging to special cosmetics, the applicant can adjust the application materials and continue to review and approve according to the procedures.

 

On February 3, 2021, China Food and Drug Administration Research Institute issued an announcement on the detailed rules for the transitional treatment of five special-purpose cosmetics, such as hair growth.

According to the provisions on transitional management of five types of special-purpose cosmetics such as hair growth in the Announcement on Implementing the Regulations on the Supervision and Administration of Cosmetics (No.144 of 2020) issued by the State Drug Administration, China Food and Drug Inspection Institute (hereinafter referred to as the "Chinese Inspection Institute") has treated the five types of special-purpose cosmetics such as hair growth, hair removal, beauty, body building and deodorization according to different situations:

First, four types of products: hair removal, beauty breast, bodybuilding and deodorization：

In the cosmetics administrative license management system, 170 products including hair removal, beauty care, body building and deodorization have been accepted (see Schedule 1 for specific information). The applicant should take the following two ways to return the original application materials before March 31, 2021:

 

(a) with the acceptance notice (stamped with the original special seal for the acceptance of administrative license of the State Drug Administration), the power of attorney (stamped with the official seal of the applicant) and the photocopy of the ID card of the handler, go to the Administrative Acceptance Service Hall of the State Drug Administration (hereinafter referred to as the acceptance hall) to collect the original application materials on site;

 

(b) After mailing the acceptance notice (with the original special seal for administrative license acceptance of the State Drug Administration) and the reply statement (with the official seal of the applicant) to the acceptance hall, the Chinese Inspection Institute will return the original application materials according to the address and contact person in the reply statement.

 

The original application materials that are not received within the prescribed time limit will be uniformly filed by the Central Inspection Institute and handed over to the State Drug Administration.

 

Second, the hair-raising products:

In the cosmetics administrative license management system, a total of 133 hair care products have been accepted (see Schedule 2 for specific information), and the Central Inspection Institute will issue a review opinion of "Please confirm the product category, if it belongs to anti-hair loss cosmetics, please adjust and supplement relevant information according to the current regulations". The applicant adopts the following two ways:

 

(a) If it is confirmed as an anti-hair loss cosmetic according to the Regulations on the Supervision and Administration of Cosmetics, the applicant shall adjust and supplement relevant information according to the current laws and regulations, and the application for administrative license will continue to be reviewed and approved according to the procedures.

 

(b) in accordance with the "Regulations on the Supervision and Administration of Cosmetics", it is confirmed that it belongs to cosmetics but does not belong to anti-hair loss cosmetics, and then the applicant can handle the filing of ordinary cosmetics. At the time of filing, the product inspection report, safety assessment data and relevant certification documents in the original administrative license application data can be submitted as filing data. Since the original related data has been submitted along with the original administrative license application and cannot be obtained, a copy can be provided and stamped with the official seal of the applicant, and relevant explanations can be submitted at the same time.

 

If the review opinion "Please confirm the product category, if it belongs to anti-hair loss cosmetics, please adjust and supplement relevant information according to the current regulations" issued by the Central Inspection Institute fails to submit supplementary information within the prescribed time limit, it will not be approved for processing according to the overdue submission of supplementary information, and the Central Inspection Institute will uniformly file the information and hand it over to the State Drug Administration.

 

Third, reissue, correct and change the approval documents of five types of products such as Yufa:

 

If an applicant applies for reissue, correction and change of the approval documents of five special-purpose cosmetics, i.e., hair growth, hair removal, beauty, bodybuilding and deodorization (only changing the name, address, address description of the actual production enterprise (the actual production enterprise address remains unchanged) or the domestic responsible person), his application for administrative license will continue to be accepted, reviewed and approved according to the procedures, and other licensing matters will not be accepted.

 

It is hereby announced.
