From January 16, 2021, the South Korea Industry Safety and Health Care Law-MSDS Amendment Regulations will be formally implemented. Our New Anrun Consulting and South Korea Chemtopia jointly launched a detailed series of amendments to the regulations. In addition to analyzing the main points of amendments to the MSDS regulations, we also designed the response process and scheme in combination with the actual situation of enterprises. This issue is a basic concept article, which introduces the background of the regulations, the subject of obligations, the applicable object, the MSDS submission period and so on.

Regulatory Background:

The Chinese name of MSDS is "Chemical Safety Technical Instructions". Its purpose is to help manufacturers manage chemicals systematically, so that operators can better understand the dangers of chemicals, ensure personal safety and prevent accidents. However, the frequent occurrence of chemical accidents in factories in recent years reflects that there are many problems such as insufficient risk information of MSDS, low credit, unclear risk description, non-standard trade secrets and so on, resulting in the actual operation staff can not obtain sufficient safety information. The revised regulations focus on requiring manufacturers to submit MSDS to the government for review, and trade secrets require prior official approval.

subject of obligation

In the new regulations, an "agent" appointed by an overseas manufacturer has been added to the subject of obligation ". At the same time, the subject of the obligation in the territory of the South Korea is determined by the previousTransfer/Provider, revised to focus more on source management.manufactures/importers.

Manufacturing: The production, processing, mixing or repackaging of chemical substances or mixtures for direct use or for the purpose of transfer or supply.

* Import: The introduction of a chemical substance or mixture from abroad into the country for direct use or for the purpose of transfer or supply.

Applicable Object

Chemicals that need to be submitted to the MSDS for official review are limited to chemical substances or mixtures of the classification criteria in Article 104 of the applicable regulations.

In Part 3 of the MSDS, only relevant information on harmful and dangerous components needs to be filled in, and other component information shall be submitted separately in the form of confirmation. Chemicals for scientific research and development, such as reagents and process trials, do not need to be submitted to the authorities, but need to be prepared and transmitted to the user.

MSDS submission deadline

According to the actual preparation of the MSDS completed period as a benchmark, the submission period is different. The grace period is applicable to chemicals that have been circulated in South Korea before the implementation of the new regulations. Chemicals that have been circulated for the first time after the implementation of the new regulations need to submit MSDS to the official before manufacturing or importing.

* When the relevant information changes after the MSDS is submitted, the updated MSDS needs to be submitted immediately. The updated contents include:

-Product name (only if the ingredient name and content have not changed)

-Name and content of ingredients in accordance with the classification criteria of Article 141 of the Rules of Enforcement of Applicable Regulations

(Only if the product name is not changed, but only the name and content of the ingredients are changed)
