Mr. Zhang of Xin 'an Run Consulting made an accurate interpretation of the revision of China's new chemical substance regulations, and introduced the key points of the revision of the regulations, the response to the declaration of new chemical substances, and the convergence policy. About 50 participants from mainland China, Taiwan, South Korea, etc. participated in this webinar.
In the Q & A session of the seminar, the students actively asked questions and interacted with teachers. We listed some of the questions as follows:
Revision of South Korea Industrial Safety Law-MSDS Compilation and Response Topics
1. Q: Does SDS's OR conflict with K-REACH's OR? Do you need the same OR?
A: If there is no conflict, the laws and regulations are different, and the approval authority for OR declaration is also different, so there is no need for the same OR.
2. Q: If the product as a whole does not have GHS classification, can it be filed without SDS?
A: It can be understood that, but it should be noted that the classification standard is "GHS classification stipulated in the South Korea Industrial Safety Law".
Interpretation of Revision of New Chemical Substances Regulations in China
1. Question: Should the annual report be made according to the new regulations or the old regulations? According to the new regulations, it is required to submit the annual report on the regular certificate. It seems that there is no old certificate. How to do it? Is there no detailed explanation in this aspect?
Answer: According to the "Guidelines for the Environmental Management of New Chemical Substances" (hereinafter referred to as the "Guidelines"), "If the environmental management requirements on the regular registration certificate stipulate the requirements for submission of annual reports, the holder of the registration certificate or his designated agent shall comply with the" Measures "The second paragraph of Article 41 stipulates that the annual report of new chemical substances shall be submitted before April 30 each year from the year following the date of registration."
After the entry into force of Decree No. 12 on January 1, 2021, it will be implemented in accordance with the requirements of Decree No. 12. If the registration certificate obtained under Decree No. 12 states that the annual report is required to be submitted, the corresponding annual report shall be submitted in accordance with the regulations. For the registration certificate obtained under Decree No. 7, the annual report shall be submitted for key environmental management hazardous new chemical substances.
2. Q: We have a raw material that we want to use, but the raw material manufacturer has not declared a new chemical substance for this raw material. We want to declare it ourselves. Is it feasible?
A: In the case of substances that are not "to be converted to other industrial uses" and "to implement environmental management registration for new uses", the applicant for the new chemical substance should be the producer or importer. That is, if the raw material manufacturer is an overseas enterprise, then your company as an importer can make a declaration of new chemical substances; if the raw material manufacturer is a domestic enterprise, then in principle only the manufacturer can be the declarant.
3. Q: We plan to transmit the product specification or MSDS to the downstream, but the transmission evidence is difficult to collect. Is it necessary for the downstream to submit a report such as "reminder documents related to new chemical substances have been received?
A: If a report similar to "Reminder Documents Related to New Chemical Substances Received" can be submitted downstream, the integrity of the evidence can be well guaranteed. If not, the e-mail transmitting the information can be filed for future reference.
4. Q: Our new chemicals are non-hazardous new chemicals, so does the company need to record all sales when operating?
A: The sales situation, including downstream user information, sales volume, sales date, etc., belongs to the archived data of new chemical substance activities, which should be recorded and kept for future reference.
5. Q: To what extent does the tracking and management of new chemical substances need to be done?
A: Under Decree No. 12, the tracking and management of new chemical substances includes information transmission, activity reporting, information disclosure, tracking of new hazard information and environmental risks, data preservation, acceptance of environmental supervision and management, and inclusion in the list.
